
On the 30th June the appeal court in Palma finally denied the appeal of the German captain of the British flagged, 38 metre M.Y. Auriga that collided with the fast catamaran ferry, Milenium off the coast of Andratx in September 2000.
The fine of 5,500 Euros was upheld despite the accusation that the captain of the Milenium was partly to blame being too close to the coast at 750 metres off, travelling at approximately 40 knots.
The testimony, supplied by Trasmediterranea, the owners of the ferry, claimed that the Auriga made a sudden change of course to starboard and embedded itself in the starboard engine room of the ferry.
The payment the repair, of the fast ferry has still to be decided in a civil action.
